Thank you for choosing to pay using our online payment system. When making an online payment you are required to read and accept our Terms & Conditions, which are shown on this page.

Standard Terms and Conditions 

  1. These terms and conditions apply to all online payments made to the Milton Keynes College Group. We may change these terms from time to time without notice. Such changes will apply to any subsequent transactions with the Milton Keynes College Group. 
  2. Accepting these terms and conditions and submitting a payment via our online system constitutes the entire agreement between the parties insofar as they relate to the contract of payment. Specific terms and conditions, or specific contracts, relating to the service or goods supplied may also apply.
  3. By accepting these terms and conditions you affirm that you are, or have obtained the permission of, the cardholder of the credit/debit card details you are using to submit any service request or payment prior to making any such a submission, and that you have the authority required to make such a submission.
  4. Each right or remedy under this agreement is without prejudice to any other right or remedy available, whether under this agreement or any other agreement, contract, or legislation.
  5. Nothing in these Conditions excludes or limits the liability of the College for death or personal injury caused by the College’s negligence, or for fraudulent misrepresentation.
  6. All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act 1979) are, to the fullest extent permitted by law, excluded from the contract.
  7. Subject to Clause 5, the College’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise arising in connection with the performance or contemplated performance of the agreement will be limited to the price of the service or goods supplied.
  8. The contract will be governed by and construed in accordance with the law in England and Wales and any disputes shall be subject to the exclusive jurisdiction of the English Courts

Section 1 

On-Line Payments 

Please read these terms carefully before using the online payment system. Use of the online payment system on this website indicates that you accept these terms. If you do not accept these terms do not use this facility. All payments are subject to the following conditions. 

  1. Your payment will normally reach the College account to which you are making a payment on the working day following submission of payment. However, time should be allowed for processing transactions. 
  2. The College cannot accept liability for a payment not reaching the correct College account due to an incorrect account number, incorrect invoice reference, or incorrect personal details (including incorrect student ID) being submitted. 
  3. We cannot accept liability if payment is refused or declined by the credit/debit card supplier for any reason. 
  4. If the card supplier declines payment, the College is under no obligation to advise you of this. You should check with your supplier that payment has been deducted from your account. 
  5. The data that you provide during this transaction will only be used for the purpose of processing and recording your payment.
    • We will not use this data for any other purpose.
    • We will not share this data with unauthorised third parties.
    • We will not allow third parties to access any of the data excepting for the purposes of:
      • auditing the College transactions.
      • for the purposes of fraud detection and prevention (including identity verification).
      • for the purposes of technical support where a technical fault may have occurred.
    • The College e-commerce provider may retain some personal information so that we can access payment records in the event of queries or incomplete payment information.
    • Credit/debit card details and authentication information given by you will not be retained in their entirety.
    • Information will only be retained for a reasonable period and then destroyed. 
  6. Milton Keynes College Group shall  not be liable for any damages whatsoever arising out of the use, inability to use, or the results of use of this site, any websites linked to this site, or the materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.  This shall include the effect of any delay in receiving/processing payment arising from the online payment system being unavailable for use at any time.
  7. The College reserves the right to suspend, modify or amend the online payment system at any time.
  8. Refunds, if applicable, will only be made to the credit/debit card used for the original transaction.
    • Where payment is submitted for a service other than course fees, you have the right to cancel the online transaction within the applicable specified time limit, which is seven (7) working days from the date of agreement/submission of payment, or receipt of written confirmation, whichever is the later, except where the Services have already been provided or . If you do wish to cancel you must inform the College in writing (by letter, fax or email). Refunds will be made as soon as possible following cancellation, or within thirty (30) days at the latest.
    • Where payment is submitted for course fees, the college Fees Policy (Policies and procedures – MK College ) shall apply to any cancellation/withdrawal and refund.

Section II

Fraud Prevention

  1. The College retains the right to investigate any service request or payment placed on this website that it suspects to be fraudulent.  Any such service request or payment will not be accepted/fulfilled until it is proven that that the order is legitimate. Should the College Group be unable to prove that an order is legitimate, then the monies will be refunded to the original card that was used to place service request or payment, and the service request or payment will be cancelled. 
  2. In cases where fraudulent activity is suspected, the College reserves the right to share information on the persons submitting such service requests or payments, and the accounts used in that activity with the police, oth3er colleges, and any other organisation or department as is deemed appropriate. 
    Where such data sharing is considered necessary, the College will abide by the requirements of any applicable Data Protection legislation, and any guidance issued by an appropriate authority.
  3. For mutual protection, to ensure that your card and/or account are not being used fraudulently, the College may validate your name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions, you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. Please be assured that this is only done to confirm your identity. 
    A credit check will NOT be performed, and your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with applicable Data Protection legislation.

Security 

  1. All card and payment details entered through this gateway are encrypted when they are submitted, and the communications between the gateway and the Payment Service Provider’s site are also encrypted, using a strong and industry approved encryption standard. 
  2. The College will not be liable for any failure by the card holder making the payment to properly protect their details being seen by other persons or otherwise obtained by such persons during the online payment process or in respect of any omission to provide accurate information in the course of the online payment process. 
  3. The College will not be liable for any technical vulnerabilities, or injury or breach of data arising from technical vulnerabilities, on any devices, systems, software, or other platforms in your use when submitting any service request or payment.
